This Disclaimer governs the use of the website, mobile application, online store, social media pages, digital content, products and related services owned, operated or made available by Pryolt Private Limited, trading under the brand name “SYDLENE” (hereinafter referred to as the “Company”, “SYDLENE”, “we”, “us” or “our”). For the purposes of this Disclaimer: 

• “Platform” means the Company’s website, mobile application, online store, social media pages and any other digital platform or channel through which the Company provides information, offers Products or facilitates transactions; and

• “Products” means the lingerie, innerwear, intimate apparel, underwear, pasties, accessories and any other products offered, marketed or sold by the Company through the Platform. 

The Platform, its content and related services are made available on an “as is”, “as available” and “with all faults” basis, to the fullest extent permitted under applicable law. By accessing, browsing or using the Platform, or by purchasing or using any Product, you acknowledge that you have read and understood this Disclaimer and agree to be bound by it, subject to applicable law.

I.    NO WARRANTY OF UNINTERRUPTED SERVICE

The Company does not represent, warrant, or guarantee that:

1. the Platform, website, mobile applications, online store, payment systems, customer support services, or related systems will be available at all times or will operate without interruption, delay, outage, downtime, or technical malfunction;

2. access to or use of the Platform will be continuous, timely, secure, reliable, error-free, or free from bugs, defects, compatibility issues, or performance limitations;

3. any defects, errors, interruptions, vulnerabilities, or technical issues will be identified, corrected, repaired, or resolved within any specified timeframe; and

4. the Platform, servers, databases, software, or connected systems will be free from viruses, malware, cyberattacks, unauthorized access, harmful code, data loss, or other technological risks beyond the Company's reasonable control.
   

 II.    PRODUCT AVAILABILITY DISCLAIMER

1. The availability of Products, including but not limited to the Butter Collection, Yummy Collection, Spicy Collection, Pasties & Accessories, Undies, Underwear Multipacks, and their respective colours, sizes, styles, designs, promotional offers, stock, and inventory, may vary depending upon manufacturing, demand, inventory levels, operational constraints, seasonal collections, or other commercial factors.
   
   
2. The Company does not represent, warrant, or guarantee that:

            a. any Product, collection, size, colour, design, style, or variant will be available at                   any particular time, location, or in any specific quantity, or that stock displayed                     on the Platform will always be accurate or up to date;

            b. customers will always be able to purchase their preferred Product, size, colour,                    style, or design, or that unavailable Products will be restocked within any                             specified timeframe; and

            c. any Product, collection, promotional offer, seasonal collection, exclusive launch,                   or limited-edition item will continue to be offered, available, or sold for any                          specified duration or under the same terms and conditions.

 III.    PRODUCT DESCRIPTION, DISPLAY, SIZE AND COMPATIBILITY DISCLAIMER

1. The Company does not represent, warrant, or guarantee that:

            a. Product photographs, colours, textures, lace, embroidery, fabrics, prints, finishes,                  designs and products forming part of the Butter Collection, Yummy Collection,                     Spicy Collection, Pasties & Accessories, Undies, and other collections displayed                     on the Platform will exactly match the actual Product, owing to differences in                       photography, lighting, manufacturing processes, or screen displays;
            b.  Product measurements, size charts, fit recommendations, or specifications will                      provide a perfect fit or be suitable for every customer;
            c.  any Product will meet the customer's expectations regarding fit, comfort,                              support, appearance, or styling; and
            d.  Every Product will be identical where variations arise due to stitching, dyeing,                      finishing, or batch manufacturing;
           e.  Product colours displayed on the Platform, including colours forming part of the                Company's branding or product collections, may appear differently depending                    upon individual device settings, screen resolution, display calibration, lighting                      conditions, and photography.

1. Customers are solely responsible for selecting the appropriate size after reviewing the applicable size guide and Product specifications. The Company shall not be liable for dissatisfaction arising from incorrect size selection, fit preferences, or individual body variations.
   
   
2. Product specifications, including fibre composition, fabric content, materials, dimensions, support levels, care instructions, and other technical information (for example, material compositions such as 76% Polyamide and 24% Spandex, where applicable), are provided for general informational purposes. Customers are encouraged to review such specifications carefully before purchasing. Minor variations resulting from manufacturing processes or permissible industry tolerances shall not constitute a defect.
   
   
3. Product descriptions, comfort levels, support features, styling suggestions, intended use, and collection descriptions provided on the Platform (including descriptions such as "Everyday Wear", "Maternity", "Sports", "Wireless", "Lace", "Invisible Support", "Seamless Confidence", "Date Nights", "Bridal Wear", or similar marketing descriptions) are provided for general informational and promotional purposes only. Individual experiences relating to fit, comfort, appearance, support, and performance may vary depending on body type, personal preferences, and usage.

IV.    USER RESPONSIBILITY DISCLAIMER

1. Customers acknowledge and agree that: 
   a. they are responsible for determining whether a Product is suitable for their                individual requirements, preferences and intended use;
   
   b. they shall carefully review the relevant Product descriptions, size guides,                    measurements, specifications, materials, care instructions and other information        made available on the Platform before placing an order; 
   
   c. they are responsible for selecting the appropriate Product, size, style, colour and        fit based on the information provided on the Platform;
   
   d. they shall use, handle, wash, store and maintain the Products in accordance with    the applicable care labels, washing instructions, usage guidelines and   recommendations provided by the Company, and shall not misuse, alter or modify   the Products in a manner inconsistent with their intended purpose; and
   
   e. subject to applicable law, the Company shall not be responsible for any loss,             damage, deterioration, discomfort or dissatisfaction arising solely from incorrect       size or Product selection, misuse, negligence, unauthorised alteration, improper       washing, care or storage, failure to follow the Company’s instructions, or use of a     Product for a purpose for which it was not intended. 
   
   
2. Notwithstanding the above, where any issue arises due to a genuine error, omission or mistake attributable to the Company, including the dispatch of an incorrect Product, size, colour or quantity, a material error in the Product description, or any other verified order-fulfilment error, the Company shall take all reasonable and appropriate steps to rectify the issue in accordance with its applicable policies and applicable law. Such corrective action may include replacement, exchange, refund, correction of the relevant information or such other remedy as may be appropriate in the circumstances. 
   
   
3. Nothing in this section shall restrict or exclude any right or remedy available to a customer under applicable law in relation to defective, damaged, materially misdescribed or incorrectly supplied Products.

V.    THIRD-PARTY SERVICES DISCLAIMER

1. The Platform may use or provide access to services supplied by third parties, including payment gateways, banks, courier companies, logistics providers, hosting providers, analytics providers, social-media platforms and other service providers. 
   
   
2. The availability, operation and security of those third-party systems may be subject to the respective third party’s own terms, policies and technological limitations. 
   
   
3. The Company is not responsible for an interruption, delay, error, unauthorised act or failure caused exclusively by a third party and beyond the Company’s reasonable control, except to the extent that:
   a. the Company is responsible under applicable law;
   
   b. the third party acts as the Company’s agent or service provider in connection            with the customer’s order;
   
   c. the loss results from the Company’s negligence, omission or failure to exercise          reasonable care; or
   
   d. the Company has made an express representation or undertaking concerning the      relevant service.
   
   
4. Nothing in this section limits the Company’s obligations concerning order processing, grievance redressal, refunds, delivery commitments or other responsibilities imposed by applicable law.

 VI.    CONTENT AND ADVERTISEMENT DISCLAIMER

1. Advertisements, promotional campaigns, styling suggestions, testimonials, influencer collaborations, reviews, sponsored content, and commercial communications displayed on the Platform are provided solely for informational and promotional purposes. Collection descriptions, product categories, styling guides, "Perfect For" recommendations, promotional taglines, and marketing content available on the Platform are intended solely to describe the intended style, design, or suggested use of the Products and should not be construed as guarantees regarding performance, suitability, fit, comfort, or outcomes for every customer.
2. The Company:
   a. does not represent or guarantee that any Product will appear, fit, or perform             exactly as portrayed in photographs, advertisements, videos, or other                         promotional materials, as actual results may vary;
   
   b. does not independently verify or endorse the accuracy, completeness, or                    reliability of any representations, opinions, or claims made by third-party                 advertisers, influencers, collaborators, or customers;
   
   c. makes no warranty regarding the suitability, appearance, fit, comfort, or                      performance of any Product for every individual customer; and
   
   d. shall not be liable for any loss, damage, claim, or liability arising from a                     customer's reliance upon any advertisement, promotional content, styling                 suggestion, testimonial, review, or other marketing material available on the Platform.

VII.    LIMITATION OF TECHNICAL RELIANCE

1. Information made available through the Platform, including Product availability, pricing, inventory status, order status, delivery estimates, size availability, promotional offers, notifications, and other system-generated information, is provided for informational and convenience purposes only.
   
   
2. The Company does not warrant that such information will always be accurate, complete, current, uninterrupted, or error-free.

VIII.    NO PROFESSIONAL ADVICE

1. All Product descriptions, styling recommendations, fashion guidance, blogs, editorial content, communications, and other information available through the Platform are provided solely for general informational purposes and shall not constitute medical, dermatological, legal, financial, or professional advice. Customers should seek appropriate professional advice wherever necessary.

 IX.    FORCE MAJEURE DISCLAIMER

1. The Company will not be liable for a delay, interruption or failure in performance caused by an event beyond its reasonable control, including natural disasters, floods, fires, epidemics, pandemics, governmental restrictions, war, civil disturbance, transportation disruption, supply-chain interruption, labour disputes, internet or telecommunications failures, cyber incidents, power outages or similar events. 
   
   
2. The Company will take reasonable steps to minimise the effects of such an event and will fulfil any refund, cancellation, disclosure or other obligation required under applicable law.

  X.    LIMITATION OF LIABILITY

1. To the fullest extent permitted under applicable law, the Company shall not be liable for:
   a. any indirect, incidental, consequential, special, exemplary or punitive damages          arising from the access to, purchase, use of, or inability to use the Platform or            Products; any loss of profits, revenue, business opportunities, goodwill,
        reputation, anticipated savings or other commercial or economic losses; 
   
   b. any allergic reaction, skin sensitivity, irritation, discomfort or dissatisfaction                relating to fit, support, comfort, appearance or performance arising from                    individual body characteristics, pre-existing conditions, incorrect size selection,          improper use or failure to follow the applicable care and usage instructions; 
   
   c. any delay in order processing, shipment, delivery or fulfilment, business                      interruption, personal inconvenience or loss of use caused by circumstances              beyond the Company’s reasonable control; or 
   
   d. any loss, damage, cost or liability arising from misuse, improper handling,                 unauthorised alteration, incorrect selection or reliance upon general information       made available through the Platform.
   
   
2. However, nothing in this clause shall exclude or limit the Company’s liability for any defective, damaged, unsafe, contaminated, materially misdescribed or incorrectly supplied Product, any genuine error attributable to the Company, fraud, wilful misconduct, negligence, breach of an express warranty, misleading representation or any liability that cannot lawfully be excluded or restricted. 
   
   

3. Where a genuine and verified mistake is attributable to the Company, the Company shall take reasonable and appropriate steps to rectify the same in accordance with its applicable policies and applicable law.

   
   

 XI.    USER ACKNOWLEDGEMENT

1. By accessing or using the Platform or purchasing any Product, the customer acknowledges and agrees that they have read, understood, and accepted this Disclaimer and that their use of the Platform and Products is voluntary and undertaken at their own risk, subject to applicable law.

XII.    MODIFICATIONS

1. The Company reserves the right to amend, modify, update, supplement, or replace this Disclaimer at any time at its sole discretion;
   
   
2. Any modifications shall become effective upon publication on the Platform unless otherwise specified by the Company.

XIII.    GOVERNING LAW AND JURISDICTION

1. This Disclaimer shall be governed by and construed in accordance with the laws of India;
   
   
2. Subject to applicable law, the courts in Jaipur, Rajasthan (India) shall have exclusive jurisdiction over any dispute arising out of or relating to this Disclaimer.

XIII.    SEVERABILITY

1. If any provision of this Disclaimer is held to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the minimum extent necessary to make it enforceable;
   
   
2. If that is not possible, it will be severed, and the remaining provisions will continue in full force to the extent permitted by law.
